Why the EIN Gates Everything Else
Getting an EIN without an SSN is the first real obstacle most non-resident founders meet. An EIN — Employer Identification Number — is your company's federal tax identification number. It is the US equivalent of a company tax reference, and practically nothing happens without it.
Until you apply for an EIN and receive it, there is no business bank account. No Stripe. No PayPal Business. No Amazon Seller Central. No Shopify Payments. Every one of those asks for the EIN confirmation letter before they will proceed, which is why this single step determines how quickly your company becomes operational.
The EIN application is also where non-resident founders lose the most time, and almost always for one avoidable reason, which the next section deals with.
To Get an EIN Without an SSN, You Do Not Need an ITIN First
This is the most expensive misunderstanding in the whole process, and it is worth stating as plainly as possible.
This is the single most important fact about the EIN for non-residents. An EIN belongs to the business. An ITIN belongs to a person. They are separate numbers, issued under separate processes, for separate purposes. You do not need the second to obtain the first.
If you apply for an EIN as a non-resident, the Form SS-4 instructions are explicit: where the responsible party has no SSN or ITIN and is not eligible for one, you write FOREIGN on line 7b. Not blank. Not a passport number. Not "applied for". The word FOREIGN.
So you can get an EIN without an SSN and without an ITIN. There are situations where you genuinely need an ITIN — they are covered further down — but obtaining an EIN is not one of them. If an adviser tells you otherwise, ask them to point to the line in the SS-4 instructions that requires it.
Who Can Be the Responsible Party
Every EIN for non-residents turns on line 7a of Form SS-4, which asks for the responsible party: the individual who controls, manages or directs the entity and the disposition of its funds and assets.
Three rules govern this.
- It must be a natural person. Since 2018 the IRS does not accept another company as responsible party, with the single exception of government entities. A parent company cannot be named.
- They can live anywhere. No US presence, address or immigration status is required. A sole member living in Bengaluru, Lagos or Dubai is a perfectly valid responsible party.
- It must be someone with genuine control. Naming a formation agent or a friend to make the paperwork easier misstates the position to the IRS and creates a problem you will have to unwind later.
If the responsible party changes after the EIN is issued, file Form 8822-B within 60 days. The EIN itself does not change.
Three Ways to Get an EIN Without an SSN
To get an EIN without an SSN you must avoid the online route entirely. The IRS online EIN Assistant requires the responsible party to hold an SSN, ITIN or existing EIN, so that route is closed — which leaves three that remain open, and they differ enormously in speed.
| Route | Speed | Detail |
|---|---|---|
| Telephone | During the call | International applicants only. +1 267-941-1099, Monday to Friday, 6 a.m. to 11 p.m. Eastern. Not toll-free. |
| Fax | Around 4 business days | Often longer for international applications. Requires a return fax number. |
| Post | Around 4 weeks or more | IRS, Attn: EIN International Operation, Cincinnati, OH 45999. |
| Online | Not available | Requires an SSN, ITIN or EIN for the responsible party. |
Most guides on the EIN for non-residents lead with fax. The telephone route is faster by a wide margin and is available specifically to applicants whose principal place of business is outside the United States.
The Fastest Way to Get an EIN: The Phone Route
This is the fastest way to obtain an EIN for non-residents, and it is under-used because most articles bury it beneath the fax instructions.
To apply for an EIN by telephone, call +1 267-941-1099, Monday to Friday between 6 a.m. and 11 p.m. Eastern Time. It is not a toll-free number, so international call charges apply. An IRS representative works through Form SS-4 with you line by line, establishes the account, and issues the EIN during the call.
The caller must be authorised to receive the EIN and answer questions about the form — the responsible party, or a properly appointed third-party designee.
Have your state formation documents ready. The IRS is increasingly asking for them before issuing an EIN for non-residents, and you may be asked to fax them during or after the call.
Write the EIN on the form when it is given, then sign and date it. The IRS may ask you to fax the signed form afterwards.
Check the time zone. 6 a.m. Eastern is 3.30 p.m. in India and 2 p.m. in the UAE — convenient windows exist for most of Asia and Africa.
The Fax Route, and the Cover Sheet Detail
Fax remains a sensible route to an EIN for non-residents if you would rather not telephone, or if the call windows do not suit you. The IRS states that faxed applications generally receive a response within four business days, though international applications commonly take longer.
Use the correct number for your location, because using the wrong one means your EIN application never arrives:
- Applicants outside the United States: +1 304-707-9471
- International applicants within the United States: 855-215-1627
- Domestic applicants: 855-641-6935 — not the number for a non-resident
Our practice is to attach the stamped formation documents to every fax application as a matter of course, and to have them to hand before any telephone application. It costs nothing to include them and it removes a round trip.
Form SS-4 Line by Line: Applying for an EIN Without an SSN
The form is one page. These are the lines that cause problems when you are applying for an EIN without an SSN.
| Line | What to enter |
|---|---|
| 1 β Legal name | Exactly as it appears on your state formation documents, including the suffix. A single character of difference causes rejection. |
| 4aβ4b β Mailing address | A foreign address is accepted. Many founders use the registered agent address instead, which helps if you want post to reach you. |
| 6 β County and state | Where the principal business is located. For a formation-state entity, the state of formation. |
| 7a β Responsible party | A natural person with genuine control. Never an entity. |
| 7b β SSN, ITIN or EIN | FOREIGN where the responsible party has none and is not eligible. Not blank, not a passport number. |
| 8aβ8c β LLC questions | Tick LLC, state the number of members, and answer the organisation question. The member count drives your federal filing obligations. |
| 9a β Entity type | For a single-member foreign-owned LLC this interacts with your Form 5472 obligation. Get advice if unsure. |
| 10 β Reason for applying | Usually "Started new business" or "Banking purpose". Be accurate. |
| 16 β Principal activity | Plain and specific. This is compared against what you later tell your bank. |
| Third Party Designee | Complete only if authorising someone to receive the EIN on your behalf. The authority ends the moment the EIN is released. |
| Signature | Signed by the responsible party named on line 7a. Unsigned forms are returned. |
Before you apply for an EIN, always download the current form from the IRS website and check the revision date in the bottom-left corner. Outdated versions are rejected, and the form is revised periodically.
CP 575, Letter 147C and What Arrives
Two documents, and the distinction matters when you have obtained an EIN without an SSN from abroad.
CP 575 is the original confirmation issued once your EIN application is approved. It is issued once, sent by post, and cannot be reissued. For international founders it frequently goes astray or takes months.
Letter 147C is a replacement confirmation you can request at any time, and crucially it can be sent by fax. Banks and payment processors accept it exactly as they accept a CP 575.
This is one of the most common delays with an EIN for non-residents, because international post is unreliable. So if your CP 575 has not arrived and you are waiting on it to open an account, stop waiting. Call the IRS and request a 147C by fax. The number to call for an existing EIN is the Business and Specialty Tax Line on +1 800-829-4933, or the international line above.
Keep the confirmation permanently. You will be asked for it by every bank, processor and marketplace, and by your accountant every year.
Why an EIN Application Is Rejected or Delayed
- Legal name mismatch. Line 1 must match the state register exactly. "Acme Global LLC" and "Acme Global, LLC" are different names.
- No return fax number. The IRS posts the EIN instead, adding a month.
- Wrong fax number. Domestic and international lines are different. The form simply does not arrive.
- Line 7b left blank or filled with a passport number. Write FOREIGN.
- An entity named as responsible party. Must be an individual.
- Unsigned form, or a signature that does not match the responsible party named.
- Outdated form revision. Check the date in the bottom-left corner.
- Applying before the entity exists. The state registration should be complete first.
- Not attaching the formation documents. The IRS is increasingly requesting the Articles of Organization or Certificate of Incorporation from non-resident applicants. Sending them with the form avoids waiting to be asked.
When you apply for an EIN for several entities, note the limit of one EIN per responsible party per day, which matters if you are forming several entities at once.
EIN vs ITIN: Which You Actually Need
| EIN | ITIN | |
|---|---|---|
| Identifies | The business | An individual |
| Needed for | Banking, Stripe, Amazon, filings | Personal US tax filing obligations |
| Form | SS-4 | W-7 |
| Requires the other first? | No | No |
| Typical timing | Same day by phone | Weeks to months |
| Needs certified ID | No | Yes β passport certification |
You may genuinely need an ITIN if you have a personal US filing obligation — for example US-source income requiring a personal return, a treaty benefit claim, or a partnership that must issue you a Schedule K-1. Those are individual tax matters, not company formation matters.
Where an ITIN is genuinely required, the passport certification step is what causes most of the difficulty, because the IRS otherwise expects original documents to be posted. As a Certified Acceptance Agent, our team can certify your passport directly so the original never leaves your possession, which removes both the risk and a substantial part of the delay.
What an EIN for Non-Residents Unlocks
Once you get an EIN without an SSN and the confirmation letter is in hand, the sequence opens up quickly.
Business banking. Every platform that onboards non-residents asks for the EIN letter alongside your formation documents and identification. Our business account guide covers which platforms accept which entities, and we coordinate applications.
Payment processing. Stripe, PayPal Business, Shopify Payments and Amazon Seller Central all require it.
Federal filings. The EIN is how the IRS identifies your company for every return it files — including Form 5472, which a foreign-owned single-member LLC must file annually with a pro forma Form 1120 even at zero revenue, under a USD 25,000 penalty.
That last point is worth absorbing before you apply for an EIN, because obtaining the number is what puts the company on the IRS system and begins the filing obligations.
Mistakes Non-Residents Make
| The mistake | What it costs you |
|---|---|
| Applying for an ITIN before the EIN application | Three to six months of delay for a number you did not need. Line 7b takes the word FOREIGN. |
| Using the online EIN Assistant | It requires an SSN, ITIN or EIN for the responsible party. Without one the application cannot complete. |
| Faxing without a return fax number | The IRS posts the EIN instead β four weeks or more, often to a letter that never arrives. |
| Naming a company as responsible party | Must be a natural person. Rejected, and the application starts again. |
| Naming a formation agent to simplify the form | Misstates control to the IRS and has to be unwound later with Form 8822-B. |
| Waiting for a CP 575 that never arrives | Request Letter 147C by fax instead. Banks accept it equally. |
| Describing the business differently on SS-4 and to the bank | They are compared. An inconsistency becomes a declined account weeks later. |
| Sending Form SS-4 without the formation documents | The IRS is increasingly asking for state formation documents before issuing an EIN for non-residents. Waiting to be asked adds a round trip. |
| Treating the EIN as the end of the process | It is the beginning of your federal filing obligations, not the completion of setup. |
How CompanyVista Helps
CompanyVista is a document filing, taxation and accounting firm — not a law firm. Our team brings together US-credentialed CPAs, IRS Enrolled Agents, Certified Acceptance Agents, chartered accountants and filing specialists, with offices in Noida NCR and Albuquerque, New Mexico. Where a matter genuinely requires legal advice we work alongside independent attorneys in the relevant jurisdiction rather than offering it ourselves.
For EIN and ITIN applications we handle the whole process of getting an EIN without an SSN — preparing Form SS-4 correctly for a non-resident responsible party, attaching the state formation documents the IRS is now increasingly requesting, file it by the fastest route available to you, act as third-party designee where you would rather not deal with the IRS directly, and chase the confirmation letter or a 147C where post fails. Where an ITIN is genuinely needed, our Certified Acceptance Agent status means your passport is certified directly rather than posted to the IRS.
We also handle the company formation that precedes it and the annual filings that follow. Every engagement begins with a free consultation and a price shown before any payment.
